ListOnce Terms of Service

Welcome to ListOnce. These Terms of Service ("Terms") govern your access to and use of the ListOnce mobile application (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use ListOnce. By using the App, you represent that you meet this requirement.

2. Your Account

You are responsible for:

  • Providing accurate registration information.
  • Keeping your password secure and not sharing it with anyone.
  • All activity that occurs under your account.

You agree to notify us immediately at customersupport@listonceapp.com if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

3. What ListOnce Is (and Is Not)

ListOnce is a listing management tool for resellers. It helps you:

  • Create listing content optimized for each platform's character limits and conventions.
  • Track your inventory, costs, sale prices, and margins.
  • Manage a public storefront that links to your active listings.

ListOnce is not affiliated with Poshmark, eBay, Depop, Mercari, Facebook Marketplace, Vinted, or any other reselling platform. We do not own, operate, endorse, or have any official relationship with these services. We do not automatically post listings on your behalf — you are responsible for copying generated content into each platform and complying with that platform's terms of service.

You are responsible for ensuring that your use of any third-party platform complies with their respective terms of service, community guidelines, and applicable law.

4. Acceptable Use

You agree not to use the App to:

  • Post or upload content that is illegal, fraudulent, infringing, defamatory, obscene, or that infringes anyone's intellectual property rights.
  • List items you do not legally own or have the right to sell.
  • List items that violate any platform's rules (e.g., counterfeit goods, prohibited items).
  • Misrepresent the condition, authenticity, or provenance of items.
  • Use the App to harass, abuse, or harm other users.
  • Attempt to access other users' accounts or data.
  • Reverse engineer, decompile, or attempt to extract source code from the App.
  • Use the App for any commercial purpose other than your own personal reselling business.
  • Use bots, scrapers, or automated scripts to interact with the App.
  • Circumvent any technical limitations or security features.

We may remove content, suspend accounts, or take other action against violations at our discretion.

5. Your Content

You retain ownership of the listings, photos, and other content you upload to ListOnce ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and process it for the purpose of operating the App and (if you enable your storefront) displaying it on your public storefront page.

You represent and warrant that:

  • You own or have the necessary rights to Your Content.
  • Your Content does not infringe anyone's rights or violate any law.
  • Photos you upload depict items you actually own and are selling.

We reserve the right to remove Your Content if we believe it violates these Terms or applicable law.

6. Shared Brand List

When you add a custom brand name to ListOnce, that brand name becomes part of a shared brand list available to other users for autocomplete. Brand names entered into the shared list are not linked back to your account. You agree that brand names are not personal information and that adding them to the shared list is part of the App's intended functionality.

7. Public Storefront

If you enable your public storefront, the URL listonceapp.com/{your-slug} becomes accessible to anyone with the link, displaying the information you have chosen to make public. You can disable the storefront at any time. You are responsible for any content that appears on your public storefront page.

We may reserve certain URL slugs (admin, support, etc.) and refuse usernames we consider misleading, infringing, or offensive.

8. Service Availability

We strive to keep ListOnce available 24/7 but make no guarantees. The App may be unavailable from time to time for maintenance, updates, or due to circumstances outside our control. We are not liable for any losses resulting from downtime.

9. Termination

You may delete your account at any time from the Profile screen in the App. Upon deletion, your data is permanently removed as described in our Privacy Policy.

We may terminate or suspend your account, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the App ends immediately.

Provisions of these Terms that by their nature should survive termination will survive (including ownership provisions, warranty disclaimers, and limitations of liability).

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CORRECTNESS.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free.
  • The information generated by the App (titles, descriptions, price suggestions, fee calculations) will be accurate, current, or complete.
  • Items listed through ListOnce will sell or sell at any particular price.

Platform fees, policies, and APIs change frequently. Our fee calculator and similar tools are best-effort estimates and may be outdated. Always verify with the actual platform before relying on the calculations for important financial decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LISTONCE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability to you for any claim arising out of these Terms or the App will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) US $50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless ListOnce, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any third party's rights, including any platform's terms of service.
  • Content you upload or list through the App.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Continued use of the App after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Orange County, Florida, and you consent to personal jurisdiction in those courts.
